The Scape Game - Term and Conditions

1. Introduction and Acceptance

1.1 Agreement: These Terms and Conditions ("Terms") form a legally binding agreement between you ("Player," "User," or "you") and Freedom World Group Limited, a legal entity organized under the laws of the British Virgin Islands ("we," "us," or "our"), governing your access to and use of The Scape game ("Game"), including all related services, content, and updates.

1.2 Acceptance: By downloading, installing, accessing, or playing the Game, you:

  • Confirm that you are at least 20 years of age (or the age of majority in your jurisdiction). If you are younger than 20 years old (or the age of majority in your jurisdiction), you must get permission from a parent or legal guardian to open an account and that parent or legal guardian must agree to these Terms. If you do not understand this provision, please do not create an account until you have asked your parent or legal guardian for help. If you are the parent or legal guardian of a minor who is creating an account, you must accept these Terms on the minor's behalf and you will be responsible for all use of the account or services, including purchases or other transactions made by the minor in connection with the services of the Game, whether the minor's account is now open or created later and whether or not the minor is supervised by you during such purchase or other use of the services.Agree to these Terms, Freedom World Terms and Conditions, NFTs Terms and Conditions, Privacy Polic and Code of Conduct.
  • Consent to the collection and use of location data for gameplay purposes as outlined in Clause 2.3 (Location Services) and the Privacy Policy.

1.3 Updates to Terms: We may update these Terms at our discretion. Changes will be effective upon posting to info.freedom.world/blog or in-game notification. Your continued use of the Game after such changes constitutes acceptance of the revised Terms.

1.4 Definitions

Unless the context requires otherwise, the capitalized terms used in these Terms shall have the following meanings:

"Account" has the meaning given to it in Clause 2.1 (Freedom World Account) of these Terms.

"Booster Pack" means a type of in-game digital pack consisting of a set of randomly selected NFT Cards, as described in Clause 3.3 (Booster Packs and NFT Cards) of these Terms.

"NFT Card" means an in-game digital card issued as a non-fungible token (NFT). Each NFT Card may possess specific characteristics, functionalities, or rarity levels that can influence gameplay in the Game, as described in Clause 3.3 (Booster Packs and NFT Cards) of these Terms. Unless otherwise provided in these Terms, the issuance, use, and transfer of each NFT Card shall be governed by the NFTs Terms and Conditions as applicable.

"Consumables" means a type of in-game digital item that is designed for one-time or limited use and is depleted upon activation or over time. Examples include, without limitation, time-limited boosts, power-ups, speed enhancements, extra lives, or other similar effects that provide temporary advantages or benefits within the Game.

"FDS" or "Freedom Shards" means a utility token created and owned by our group company which is used to purchase the Game’s Items from the Scape’s Shop and the NFT Cards from the NFT Card Marketplace.

"FDM" means a utility token created and owned by our group company which is used to purchase the Game’s Items from the Scape’s Shop and the NFT Cards from the NFT Card Marketplace.

"Freedom World" means Freedom World application which is a digital platform, whether in mobile application or web-based form, operated and provided by our group company, through which Users can access, download, and interact with various digital services and content, including but not limited to the Game, community features, and other related functionalities made available from time to time.

"Items" means the Consumables and the Booster Pack as defined in Clause 3.1 (Purchasable Items) of these Terms.

"NFT Card Marketplace" means the official digital marketplace operated by our group company, where NFT Cards may be traded, sold, or transferred exclusively among Players. The NFT Card Marketplace facilitates peer-to-peer transactions of NFT Cards and ensures that all such transfers comply with Freedom World’s rules, technical protocols, and applicable terms and conditions as may be implemented.

"Scape's Shop" means an in-game shop where the Users can purchase the Game’s Items.

2. Account Registration and Requirements 

2.1 Freedom World Account: 

  • To access the Game, you must register and maintain an active account through the Freedom World ("Account").
  • Each Player is limited to one Account. Sharing, selling, or transferring Accounts is strictly prohibited.

2.2 Identity Verification:

  • In some cases, we may require identity verification (e.g. government-issued identification card) for Account recovery, security checks, or investigation of suspicious activity.
  • Providing false or misleading information may result in immediate and permanent Account termination.

2.3 Location Services:

  • Continuous enabling of location services is mandatory during gameplay. Location data is collected to:
    • Enable core Game functionality and features.
    • Prevent fraud and ensure fair play.
    • Comply with regional laws and regulations.
  • Disabling location services results in losing access to Game or suspension of gameplay in case of Codes of Conduct violation detection (due to any act of cheating).

2.4 Account Security:

  • You are responsible for maintaining the confidentiality of your Account credentials.
  • You must notify us immediately of any unauthorized use of your Account via [email protected]
  • You acknowledge and agree that we have no duty or obligation to verify or confirm the actual identity of the person who accesses your Account using validly issued credentials.
  • We are not liable for losses resulting from unauthorized access due to your failure to secure your Account.

3. In-Game Purchases and Virtual Economy

3.1 Purchasable Items:

  • The Game offers the following virtual items for purchase ("Items"):
    • Consumables
    • Booster Packs.

3.2 Payment Terms:

  • All purchases of Items must be made using FDM or FDS, available through Freedom World.
  • By completing a purchase, you:
    • Represent that you are authorized to use the payment method, FDM and/or  FDS.
    • Acknowledge that all sales are final and non-refundable, except where required by applicable law.
    • Agree to resolve payment disputes directly with the payment processor.
  • Prices are subject to change without prior notice.

3.3 Booster Packs and NFT Cards:

  • Contents: Booster Pack contains a set of randomly selected NFT Cards. Each NFT Card is a unique digital asset with verifiable ownership recorded on blockchain.
  • Randomization: The contents of each Booster Pack are determined at the time of opening and cannot be previewed, selected, or influenced by the User. NFT Cards in Booster Packs are randomly assigned with the following odds:
    • Uncommon: 75%
    • Rare: 20%
    • Epic: 5%

    Probabilities are calculated independently for each NFT Card and may be adjusted at our discretion with notice via info.freedom.world/blog, Freedom World’s social media channels and the Game’s community social feeds.
  • No Guarantees: We make no representations, warranties, or guarantees regarding the rarity, characteristics, or value of any NFT Card obtained through the Booster Pack. Users acknowledge and accept that the outcome of each Booster Pack is determined entirely by random selection based on the probabilities described above and may not meet personal expectations.
  • Ownership and Trading:
    • Upon purchase, NFT Cards are minted to your wallet on Freedom World and are fully owned by you as non-fungible tokens (NFT), subject to blockchain network rules, pursuant to the NFTs Terms and Conditions (as applicable).
    • NFT Cards may be traded, sold, or transferred among Players exclusively through the NFT Card Marketplace. Any attempt to trade, sell, or transfer NFT Cards through in-game chat, posts, private messages, within the Game or Freedom World, or through any other unofficial channel is strictly prohibited. We shall bear no responsibility or liability for any transactions, losses, or disputes arising from the transfer or sale of NFT Cards conducted outside of the NFT Card Marketplace.
    • We do not guarantee the liquidity, value, or availability of NFT Cards listed on NFT Card Marketplace. All trades, listings, and transactions are conducted at your own risk. We are not liable for any loss, damage, or claims arising from transactions on the NFT Card Marketplace for the actions or omissions of third parties.
    • We may impose a fee on each transaction conducted on the NFT Card Marketplace. By listing a NFT Card for sale or agreeing to purchase a NFT Card from another Player, you acknowledge and accept the obligation to pay such fee as specified by us displayed in the NFT Card Marketplace. The fee will be applied automatically upon completion of the transaction, and you agree to be bound by any such fees associated with your actions on the NFT Card Marketplace.
    • You acknowledge that:
      • The value of NFT Cards may fluctuate based on market conditions beyond our control.
      • Trading NFT Cards involves risks, including potential loss of value or blockchain network failures.
      • You are responsible for complying with all tax obligations related to transactions of Cards.
  • License for In-Game Use: While you own the NFT Cards, their use within the Game is subject to a limited, revocable license granted by us. We reserve the right, at any time, to restrict, modify, suspend, or disable the use of any NFT Card in the Game for any reason, including but not limited to gameplay balancing, technical issues, or legal compliance. You acknowledge and agree that such changes may impact the utility, value, or performance of your NFT Cards, and we shall not be liable for any loss, damages, or claims arising from or related to such modifications.

3.4 Consumables:

  • Consumables are licensed to you for use solely within the Game under a limited, revocable, non-transferable license. 
  • We reserve the right, at our sole discretion, to modify, rebalance, replace, or remove any Consumables at any time, including during active gameplay. Such changes may affect the effectiveness, availability, or behavior of Consumables, and may result in their loss or reduced functionality.
  • Consumables are digital content without real-world monetary value and may not be redeemed for cash, exchanged, or transferred outside the Game. You acknowledge and agree that your use of Consumables is at your own risk, and we shall have no liability for any loss, reduction in value, or inability to use Consumables resulting from changes to the Game, technical issues, or actions taken against your account.

3.5 Loss and Replacement: We are not obligated to restore or replace any Items, NFT Cards, FDM or FDS  that are lost, deleted, or rendered inaccessible due to technical issues, account suspension or termination, wallet mismanagement, unauthorized access, or any actions or omissions by you or third parties. This includes, without limitation, losses resulting from software bugs, system failures, user error, or compromised credentials. Replacements will only be made where required by applicable law, and solely at our discretion.

4. User Conduct and Code of Conduct

In addition to complying with the Game’s Code of Conduct, you agree to observe the following additional conduct guidelines:

4.1 Prohibited Activities: You agree not to:

  • Use unauthorized third-party software, cheats, hacks, or exploits.
  • Engage in Account boosting, win-trading, or manipulation of Game mechanics.
  • Attempt to decompile, reverse-engineer, or modify Game code or assets.
  • Use macros, bots, or automation tools to gain an advantage.
  • Conduct fraudulent transactions or chargebacks related to FDS, FDM, Items or NFT Cards.
  • Manipulate NFT Card Marketplace to artificially inflate NFT Card value or exploit other Players.
  • Maintain more than one account at any given time. Creating or using multiple accounts to gain an unfair advantage, such as accumulating additional FDS or FDM, is prohibited.

4.2 Behavioral Standards: You must:

  • Treat all Players and community members with respect.
  • Refrain from hate speech, harassment, or discriminatory behavior.
  • Avoid disruptive actions that impair others’ enjoyment of the Game or NFT Card Marketplace.
  • Adhere to all chat and communication guidelines set out in Freedom World Terms and Conditions and Code of Conduct.

4.3 Enforcement: Violations may result in:

  • Temporary suspensions (seven to thirty (7–30) days, depending on severity).
  • Permanent Account bans, which may restrict access to in-game use of NFT Cards (though ownership remains intact).
  • Forfeiture of Items, FDM and FDS without refund.
  • Legal action for egregious offenses (e.g., fraud, intellectual property theft).

5. Game Modifications and Updates

5.1 Right to Modify: We reserve the right to:

  • Alter Game mechanics, features, or content, including NFT Card functionality.
  • Adjust Item availability, pricing, or Booster Pack contents.
  • Introduce new features or discontinue existing ones.

5.2 Notification: Significant changes will be communicated via:

5.3 No Liability: We are not liable for losses or dissatisfaction resulting from Game modifications, including impacts on Items utility within the Game as set out in Clause 3.3 (Booster Packs and NFT Cards) and Clause 3.4 (Consumables).

6. Termination and Account Deletion

6.1 Voluntary Termination:

  • You may request Account deletion by submitting an email through [email protected].
  • Deletion requests are subject to identity verification and may take up to thirty (30) days to process, or a longer period at our discretion. Upon account deletion, any NFT Cards remaining in your wallet will not be removed, unless they have been traded or transferred prior to the deletion of your account.

6.2 Involuntary Termination: We may suspend or terminate your Account at our sole discretion for:

  • Repeated or severe violations of these Terms.
  • Fraudulent activity or payment disputes.
  • Illegal behavior or noncompliance with regional laws.

6.3 Effects of Termination: Upon termination:

  • Access to the Game and all Consumables, FDM or FDS is revoked.
  • NFT Cards remain in your possession as blockchain assets but lose in-game functionality.
  • Any remaining FDM or FDS in your Account may be subject to separate handling (on whether to be managed, transferred, refunded, or otherwise) as determined at our sole discretion.
  • Player data may be retained as required by applicable law (please see the Privacy Policy).

7. Limitation of Liability

7.1 Disclaimer: The Game is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee:

  • Uninterrupted or error-free service.
  • Compatibility with all devices or blockchain networks.
  • Retention of FDM, FDS, Items or NFT Card functionality.

7.2 Exclusion of Liability: To the fullest extent permitted by law, we are not liable for:

  • Service interruptions or data loss.
  • Loss of Items or NFT Card value due to technical issues, market fluctuations, or third-party actions.
  • Unauthorized Account or wallet access beyond our reasonable control.
  • Indirect, incidental, or consequential damages.

7.3 Cap on Liability: Our maximum liability to you is limited to the total amount you spent on in-game purchases in the two (2) months preceding the claim.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of the British Virgin Islands. Any dispute arising out of or relating to these Terms shall be resolved through negotiations. If no resolution is reached, the dispute shall be submitted to arbitration or mediation as mutually agreed by the parties.

9. Miscellaneous Provisions

9.1 Force Majeure: We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, blockchain network outages).

9.2 Severability: If any provision of these Terms is deemed invalid, the remaining provisions remain in full force.

 9.3 Language: These Terms are provided in English. Any translation of these Terms (if any) is provided for convenience only and shall have no legal effect. In the event of any discrepancy between the English version and a translated version, the English version shall prevail.
